California Fair Employment and Housing Act - Government Code - Scroll to Sections 12900 to 12996

This state law prohibits employment discrimination because of the race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, and sexual orientation, and describes the powers and procedures of the California Department of Fair Employment and Housing, and the California Fair Employment and Housing Commission. Start at section 12940 for the provisions regarding discrimination in employment. The Family Rights Act concerning family and medical leaves begins at section 12945.1. Section 12940(k) concerns reasonable accommodation for physical and mental disabilities. Section 12941(a) concerns age discrimination against persons age 40 and older. Section 12945 relates to pregnancy-related employment discrimination.

Prohibits wage discrimination based on sex in jobs that require equal skill, effort, and responsibility, and are performed under similar working conditions.

California Constitution, Article 1, Declaration of Rights: Section 8 - Non-discrimination; and, Section 31(a) - "Proposition 209"

Section 8 states that a person may not be disqualified from entering or pursuing a business, profession, vocation, or employment because of sex, race, creed, color, or national or ethnic origin. Section 31(a) provides that the State shall not discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, or ethnicity, or national origin in the operation of public employment, public education, or public contracting.
